"orderbriefjes" to prove that I will pay back?
[Gesteld op: 26-02-2010]
Toelichting: I am a non-EU student studying in the Netherlands. Due to some accidents, I have to pay the school 14000 euros of damage fee. The school understand that I cannot pay it back all at once and is willing to let me pay in installments as long as I pay them back within 1~2 years. However, they want to have some kind of agreement or guarantee to ensure that I will pay them back.
Can I go to a notary (or a lawyer?) and make a promissory note (orderbriefjes), and saying that if I fail to pay within due time, then they can seize my property in my home country? Will that be legally enforceable? Should I provide any additional information before going to the lawyer/notary?
well, its not a requirement to go to a notary public to have a promissory note being drawn up. Is is sufficiant to draw up an agreement between you and the creditor.
I guess they like some kind of security. Only saying that they may seize your property in your hjome country will probably be not acceptable to them. Cross border seizure is a major problem and consequently hardly acceptable.
From a tactical point of view , i would suggest them to come with suggestions. Jsu agree to an agrement to pay back your debts. If they like some kind of securrity: fine.let them come with suggestions and agree to them.
How the hell yu come up with so huge amount of damages caused by yu ?
